You are a Brand Owner
If you own a brand and place products bearing your trademark on the Sri Lankan market — even if you do not manufacture them yourself — you are classified as a Brand Owner under EPR rules.
Who is a Brand Owner?
A Brand Owner is any entity that:
- Sells products under its own brand name or trademark
- Commissions or licenses the production of goods marketed under its brand
- Is the first entity to introduce branded products to the Sri Lankan market
- Uses its logo/name on packaging or the product itself (even if manufactured by a third party)
Even if you do not physically produce the items, as the brand owner you are considered the **producer** for EPR purposes and carry the legal responsibility for the post-consumer waste generated by your branded products.
Your EPR Responsibilities
Under Sri Lanka’s Extended Producer Responsibility framework, Brand Owners must:
- Register with the designated Producer Responsibility Organization (PRO)
- Organize or finance collection, take-back, and recycling systems for end-of-life products
- Meet national or category-specific collection and recovery targets
- Submit annual reports on products placed on the market and waste managed
- Ensure proper labeling and provide information to consumers about return/recycling options
